Check Dear [Documented Reference Check]: I am enclosing for your review a copy of the recent decision we received from the West Virginia Supreme Court of Appeals in the Jana Tudor case. I thought this decision would be of particular interest to you since there is a significant discussion concerning the DRC report. Of particular note is the ruling by the Supreme Court that the DRC report constituted a business record which allowed it to be admissible without requiring live testimony from the DRC representative who was involved in the underlying conversation. This ruling may prove useful to other lawyers who will seek to introduce such reports into evidence in other cases.
